Terms of purchase

1. General conditions of purchase

1.1 These terms of purchase apply when you as a consumer/customer place orders from Hamphi AB, organization number 559197-3747, on Hamphi.com. These terms of purchase are only applicable to you who are a customer/consumer and place orders via Hamphi.com

1.2 When placing orders on Hamphi.com, a purchase agreement is entered into between you and Hamphi AB, please note that there is no binding purchase agreement with Hamphi AB until you have received a receipt copy or invoice of your delivery. Your order confirmation is not a valid receipt. The contract is concluded in Swedish. Purchase agreements are archived and kept available for the customer. In order to make a purchase, you must accept these terms of purchase. By completing the purchase, you agree to Hamphi AB's terms of purchase on Hamphi.com and undertake to comply with the terms of purchase in full.

1.3 To be able to order on Hamphi.com, you as a customer must be 18 years of age or older because, according to Swedish law, we do not accept credit purchases to persons under the age of 18. If you are under 18 years of age, parental consent is required before ordering. We reserve the right to change or refuse an order in certain circumstances (e.g. if the customer has provided incorrect personal data).

1.4 We reserve the right for final sale and any typographical and pictorial errors. Examples include errors in product descriptions, product technical specifications, lists of contents, instructions for use, incorrect prices or incorrect information regarding whether an item is in stock. This also includes incorrect prices that arise as a result of manual handling errors or technical errors. Hamphi.com has the right to adjust any inaccuracies and to change the information at any time. All images are to be understood primarily as illustrations and thus cannot be guaranteed to accurately reflect the exact appearance of the goods.

1.5 Hamphi.com as a store and website is owned by Hamphi AB. The content of the website is owned by Hamphi AB, our partners or its licensors.

1.6 When you place your order with us, you provide your personal data. In connection with your registration and order, you agree that we store and use your information in our business to fulfill the agreement with you. Under the Personal Data Act, you have the right to receive the information we have registered about you. If it is incorrect, incomplete or irrelevant, you can request that the information be corrected or removed. In this case, please contact us by e-mail at info@hamphi.se

1.7 We reserve the right to change prices without prior notice, e.g. in case of major changes in exchange rates. Products in stock are always delivered at the confirmed price and if the price of a product in stock changes between order and delivery, the price given in the order confirmation applies. For products that are not available in stock when the order is placed, the order-confirmed price applies with reservation for price adjustments from the supplier or other circumstances beyond Hamphi AB's control. If a new price can be offered on the order, this must be approved by the customer, otherwise the order will be canceled. We reserve ourselves against any inaccuracies and changes beyond our control. We reserve the right to cancel a trade if incorrect prices are listed on the website, as they are automatically registered. The listing is a copy of your shopping cart and not our acceptance or confirmation of the order.

2. Prices and payment

2.1 When ordering on Hamphi.com, the prices listed on the website at the time of ordering for the respective country apply. Our prices on Hamphi.com(the main domain) are quoted in Swedish Krona, you have the option to choose to see prices in your local currency. If you are outside the EU, your local VAT will be added to the goods as well as customs duties, within the EU all taxes and customs duties are included. Prices do not include any shipping charges and payment fees, which are indicated separately and clearly before the customer finalizes the order.

2.2 You as a customer have the option to show prices including VAT or excluding VAT (business customers, customers in Norway and Åland as examples).

2.3 Svea - Company invoice

Credit check: When applying for payment via company invoice, the usual credit check is carried out, which may mean that a credit report is obtained.

Payment terms: The due date and other terms for company invoices are stated on the invoice. In the case of invoice payment, payment must be received within 30 days of the invoice date. In the event of late payment, a reminder fee of SEK 60 and penalty interest of 2% per month from the due date until full payment is made will be added.

Assignment: All company invoices will be assigned to Svea Bank AB, 556158-7634 ("Svea Bank"). All payments in respect of the invoice shall be made to Svea Bank.

GDPR: When paying via company invoice, the invoice will be transferred to Svea Bank AB and we will then share the corporate customer's personal data with Svea Bank. Svea Bank is the data controller for the receivables that we have transferred to Svea Bank. 3 Promotions and offers

3.1 Hamphi.com may, during certain periods and circumstances, offer promotions which may have more favorable prices or terms than those set out in these Terms of Sale. Such more favorable terms will apply for the duration of the promotion or offer and will apply to the specific goods covered by the promotion or offer. We reserve the right to withdraw them at any time. Upon termination or withdrawal of a promotion or offer, these Terms of Purchase will apply without modification. Offers on specific products are valid for a limited time and/or while stocks last.

4. Delivery and transportation

4.1 Hamphi.com delivers in Europe and worldwide, for more information please contact us at info@hamphi.cabout or see which countries we deliver to at checkout.

4.2 Orders received before 14:00 are usually shipped the same day. Delivery time thereafter is 1-5 working days depending on the shipping method and recipient country. Unfortunately, we cannot influence any delays by the shipping company. In case of such delivery delays, we will continue to monitor the order.

4.3 Please check that the delivery details such as name, address and phone number are correct before finalizing the purchase. Unfortunately, it is not possible to change these details once the order has been packed in our warehouse.

4.4 If the parcel is to be collected from an agent, the customer will receive a notification describing where and when the parcel is to be collected. In this case, the customer must collect the parcel within the time specified in the notification, which depends on the shipping option you choose. Notification can be done by email, SMS or regular mail. Normally, parcels must be collected in person with a parcel ID and valid identification. 4.5 Made-to-order or out-of-stock items have a longer delivery time, on items from European suppliers this delivery time is usually 1-2 weeks. For goods manufactured outside Europe, the delivery time is usually 2-4 weeks. See the current stock balance under each product on the website. We reserve the right for typing errors and incorrect stock balances. If you have any questions about the delivery time and the current delivery time of goods, please contact customer service at info@hamphi.cabout. Please note that ordering products that are made-to-order may in many cases involve shipping from external warehouses and external suppliers. If you wish to make a return or cancel your order due to a long delivery time, you must return your package after you have received it. The packages are sent out automatically as all freight is booked when ordering, so you as a customer must pick up the packages at your agent and then contact us to make a return.

4.6 Hamphi AB reserves the right to upgrade your shipping and delivery method for your order free of charge and without giving you a reason. This may be due to changes in the terms and conditions of certain shipping companies that we use, it may also be due to inaccuracies in our shipping system so incorrect shipping companies or shipping services are presented to you at the time of ordering.

4.7 In the event of a refused delivery, an additional fee of SEK 1000 (incl. VAT) will be charged to cover the shipping company's handling and any storage fees. We also charge this cost in cases where you wish to change the delivery address afterwards (depending on the shipping method, it is not always possible to implement). In the case of changes to larger deliveries, there may also be a storage fee from the shipping companies, this is invoiced directly to you as a company or private individual. The cost is added to any return costs.

4.8 Particularly large items such as roof boxes, rear boxes, bicycle racks and other bulky products delivered by home delivery are not covered by free shipping over SEK 1000. The shipping cost for these items is shown at checkout and varies depending on the chosen destination of your package.

5. Right of withdrawal

5.1 We offer 14 days of open purchase to you as a private person (not companies). The right of withdrawal applies to products that are not uniquely linked to specific cars according to special orders or to products with a personal touch. If you regret your purchase within this period, it is important that you register your return yourself via our return form which you can find here: Return Hamphi. Via the return form, you will automatically receive a shipping label that you can print at home or at an agent to stick on the package. You will also receive a personalized return slip to be enclosed in the package with your return. The returns portal is currently available for the following countries: Sweden, Denmark, Finland, Germany. If you live in another country, you need to contact us to make a return, you need to take care of any return and customs costs yourself.

5.2 You as a customer are responsible for the return cost back to us, the return cost is divided into different levels depending on the size of the shipment you return. Keep in mind that you are responsible for the shipment until it arrives to us, therefore pack well protected!

Freight prices for returns
Packages under 3 kg in volume weight: 100 SEK

Packages between 3-50 kg in volume weight: 200 SEK

Package with a side exceeding 120 cm but not exceeding 150 cm: 300 SEK

Special large shipments
Package with a side exceeding 150 cm: 1 500 SEK

Half pallet: 2 000 SEK

Half pallet: 3,000 SEK

Flat meters or other bulky goods: 5,000 SEK


How is volume weight calculated?
In some cases, volume is converted to weight. A parcel can be light but at the same time require a lot of resources in terms of handling. For this reason, we convert the volume to weight by equating each cubic meter to 280 kg.

Example of volume weight calculation:
A package with dimensions 0.5 × 0.5 × 0.5 m has volume 0.125 m³. To calculate the volumetric weight, the volume is multiplied by 280 kg (0.125 × 280 which equals 35 kg). If the real weight of the parcel in this example would be 18 kg, you would pay the freight rate for 35 kg (i.e. the higher of the real weight or the volume weight).

In the example above, the return would have cost 200 SEK when the volume weight is between 3-50 kg and no single side of the package exceeds 120 cm.

Remember that you are responsible for the shipment until it arrives to us, so pack well protected!

5.3 All goods must be returned in their original packaging without damage. Tape and waybills may only be attached to the outer packaging. The return slip must be attached from the returns portal. If the return slip is not filled in correctly, the return slip is missing from the package or if any of the other criteria above are not met, a deduction of 20% of the value of the product will be made. From the time you have received the shipping note for your return, the package must be delivered to an agent within 14 days, otherwise the return will not be approved.

5.4 Returns may not be sent by cash on delivery or to an agent, nor may packages be sent directly to our company address, returns must go through our system to ensure tracking and proper handling in our systems. If these conditions are not met, the return will not be approved.

5.5 If you have ordered goods from a North American supplier through us, the right of withdrawal still applies (does not apply to special orders). However, the goods will not be returned to us and you will have to pay the shipping and handling costs back to the manufacturer in North America. Please note that the shipping costs for this are usually very high. Examples of North American suppliers are Unplugged Performance, T-sportline, Rally Armour.

5.6 Tesla original spare parts.

Right of withdrawal: I hereby understand that the right of withdrawal is not applicable to Tesla Genuine Parts ordered with a VIN number. This is due to the specific and customized nature of these parts which are designed to fit specifically to the specified vehicle. At the time of ordering, a warranty commitment is made on the spare parts from Tesla linked to the vehicle VIN number specified in the order.

Careful Verification: I understand that it is my responsibility to carefully check and verify the VIN number before confirming my order to ensure that the correct VIN number is entered and that the parts ordered are appropriate for my vehicle.

Discrepancy from the System: I accept that only in cases where there is a discrepancy from the company's system, such as incorrect delivery or defective product upon delivery, a return may be considered in accordance with the company's return policy.

No Warranty for Misuse: I understand that if the parts are used on a vehicle other than the one to which the VIN number belongs, this may affect warranty claims and liability in the event of any problems with the part.

By clicking "Accept Terms of Purchase", I confirm that I accept these terms and understand that my order is binding with respect to these terms.

5.7 If you are filing a return and submitting packages as a business (i.e., if your company name or other business details are listed on the original order, the order is classified as a business order), we reserve the right to refuse your return. In the event of a refused return, we also have the right to charge shipping costs at the rates set out above for booked returns.

If you wish to have your goods sent back to you, after the return has been refused, a new shipping cost will be added. This cost will be invoiced at cost price and must be paid before the goods are sent out.

6. Refund

If you have exercised your right of withdrawal and it has been accepted, we will refund what you have paid for the goods as soon as possible or at the latest within 30 days from the day we received the goods. We will not refund the shipping cost of your original purchase if you paid for this as it is a shipping service that has been used.

7. Complaints

7.1 Please contact customer service info@hamphi.cabout before returning an item, for whatever reason, for instructions and the fastest possible handling. Under the Consumer Sales Act, you have the right to complain about your purchase to us within a reasonable time (but no more than three years). If you want to complain about a product, you must do so within a reasonable time after you noticed or should have noticed the fault by contacting us. The fault should normally be a fault of origin and not caused by improper use/handling of the product. Complaints made within two months of discovering the fault are always considered to have been made in time.

7.2 To report that an item you ordered from us is faulty, we recommend that you contact us by email at info@hamphi.cabout. Don't forget to include information such as the order number and product number/product name. Describe the fault accurately for the fastest possible handling and attach pictures of the fault.

7.3 In many cases, we will need to receive the goods back to handle the complaint. In such cases, we recommend that you send the goods in a traceable and insured manner, as you as the sender are responsible for ensuring that the goods have arrived to us. It is normally the customer who initially pays for the return shipping. In the event of an approved complaint, the customer is always reimbursed for the return shipping. It is only for approved complaints that we pay the freight.

7.4 You as a customer or company must report damaged packages and products on the same day as delivery, so that you can make a claim with the shipping company. Hamphi AB does not take responsibility for warranties that customers lose on their cars when installing various products sold on Hamphi.com. Installation is at your own discretion.

7.5 If your complaint is accepted we will send out new products, if the products are out of stock we may offer you equivalent products, although we try as much as possible to offer the same products again, it is not always possible. When you receive the new products, you will also receive a return slip that you can stick on the same package to send the broken products back to us. If you do not choose to return the new products, the claim will not be accepted in full and we will charge you for the new replacement products we send out as well as the shipping for these.

8. Uncollected packages

8.1 Uncollected parcels incur a range of costs from shipping companies that we have to pay. Thus, we charge a cost for unclaimed packages of 200 SEK in addition to the return shipping. The cost is deducted from any refund.

This cost is added together with the return freight on the goods depending on its volume weight and actual weight. The cost is to cover part of our increased costs from the shipping companies for not picking up the package you ordered. That is, the actual handling and administration for the shipping company to start handling a return. Return shipping will be added according to the price list above.

This also applies if you as a customer entered the wrong phone number in your order so you did not receive SMS correctly regarding the collection of your package. Then it is your responsibility as a customer to contact us or the shipping company for your order before the package is returned to us. The amount of the unclaimed package together with the return shipping will be deducted from your refund for the order. If the refund amount on the order does not cover this cost, the remainder will be invoiced externally. If you regret your purchase and do not want to be responsible for this fee, you must collect the package and then return it to us according to the information available under Right of withdrawal.

8.2 Parcels that are to be collected from an agent will remain with the agent for up to 14 days (depending on your choice of shipping provider at checkout) before being returned to us. For larger shipments sent on a half or full pallet to your business or home address (usually tires, rims etc), special conditions apply see section 4.7.

8.3 Changes to existing deliveries after the package has left our warehouse are made at a cost of SEK 300 and are invoiced afterwards.

9. Dispute

9.1 We strive to resolve all matters in agreement with the customer before a dispute arises in order for you as a customer to feel satisfied with your purchase. If you have a complaint or claim against us, we are happy to receive it via our customer service. We ask you to send an email to info@hamphi.cabout.

9.2 Disputes relating to the application or interpretation of these terms and conditions of purchase shall be interpreted in accordance with Swedish law and settled by the National Board for Consumer Disputes, or ultimately by a general court.

10. Changes to terms of purchase

10.1 Hamphi reserves the right to make changes to the purchase conditions. Changes to the terms of purchase will be announced on Hamphi.com. The terms and conditions in force at any given time are available at Hamphi - Terms and Conditions of Purchase

11. Links

11.1 Hamphi.com and Hamphi AB may link to other websites which are beyond our control and vice versa. While we aim to ensure that we only link to sites that share our policies, Hamphi AB is not responsible for the protection or privacy of any information, including personal data, provided by customers on other sites. We recommend that the customer read the privacy policy of the website in question.

12. Installation

12.1 Products that are assembled by you as a customer or at our workshop are not covered by open purchase, this is because the goods after assembly are not in new condition.

12.2 If you as a customer or other third party choose to remove mounted products and other technical solutions installed by Hamphi AB, Hamphi AB reserves the right not to reassemble certain parts if they are considered to be damaged or broken due to incorrect removal from the vehicle. In these cases, you will be offered spare parts/replacement products at a discounted price to replace the broken parts. If you as a customer or other third party have chosen to remove one or more products that Hamphi AB has installed according to the customer's wishes, we reserve the right to charge you as a customer if you wish to have the equipment or products reinstalled.

12.3 Hamphi AB is not responsible for any damage that may occur to your or others' vehicles when you install any of our products on your own. Any costs associated with the installation, incorrect installation or damage from incorrect installation are the responsibility of the customer.

12.4 Cars brought into the workshop at Hamphi AB are insured against damage that may occur in connection with the installation of various products. For the current insurance policies and conditions of our respective dealers, we recommend that you contact them directly.

12.5 In case of cancellation of workshop time in full, 10% of the order value will be charged as an administrative fee. This is to cover the administrative costs incurred in connection with the cancellation of your order in the workshop as well as changes to the products prepared for your assembly.

13. Retailers/partners

13.1 Products from Hamphi.com that are sold and/or assembled by authorized dealers for Hamphi AB are covered by the same warranty and service that we at Hamphi.com offer you. Please note that assembled goods are not covered by open purchase, as the goods after assembly are not in new condition and packaging is recycled.

13.2 For the right of withdrawal at our respective retailers, we recommend that you contact them directly for the applicable conditions.

Other

We reserve the right for any typing errors and changes to technical data that are beyond our control. We reserve the right to change prices of products without prior notice.
